RARETEQUILAS.COM is not the seller of the alcoholic beverages, distilled spirits, or any other alcoholic beverages being sold. We are a platform that allows a highly respected and reputable independent liquor store sell their alcoholic beverages online. Every alcoholic beverage purchased on RARETEQUILAS.COM is sold by a partner liquor store using their liquor license. In-store pickups are available by visiting their physical location.

By ordering from RARETEQUILAS.COM you agree to the following terms:

ALL ALCOHOLIC BEVERAGES PURCHASED FROM RARETEQUILAS.COM ARE SOLD IN THE STATE OF CALIFORNIA AND TITLE PASSES TO THE BUYER IN CALIFORNIA. RARETEQUILAS.COM makes no representation to the legal rights of anyone to ship or import alcoholic beverages into any state outside of California.  The buyer is solely responsible for the shipment of alcoholic beverage products.  By placing the order, the buyer authorizes RARETEQUILAS.COM to act on the buyer's behalf to engage a common carrier to deliver the buyer's order from a legal liquor store in the state of California.

As a buyer, you are responsible for complying with the laws in the state where you reside regarding shipping as well as any applicable excise, use, and sales taxes.  Due to state laws, alcohol can be purchased only by adults 21 years and older.  Drinking alcohol may increase risk for cancer, and, during pregnancy, can cause birth defects.

Non-California residents are responsible for determining if their state or county laws allow alcohol products to be shipped into their state or county. Each state or county has their own laws and regulations related to these products. Please check with your appropriate agencies. Each individual accepts full responsibility for their state verification.

All products are sold in California, with TITLE passing to the buyer in California before shipment. 

All California residents are subject to sales tax.

Alcohol cannot be purchased by anybody under the age of 21. Person who delivers will require proof of age with an adult signature. If these circumstances are not met, alcohol will be returned to the return address. Shipper will try multiple times to deliver. Returned products are subject to a fee.

Distilled spirits can only be shipped to the states which allow the delivery of them. 

📦 Delivery Confirmation & Liability Policy

Once a package is marked as delivered by the shipping carrier (e.g., UPS, FedEx, USPS), it is considered successfully fulfilled, and Rare Tequilas is no longer liable for loss, theft, or misplacement.

We strongly recommend that customers ensure a secure delivery location or be available to receive high-value shipments. If you live in a location where package theft is possible or neighbors routinely collect packages on your behalf, please take extra precautions or consider having the package held at a pickup location.

Please note:

• Delivery confirmation, including tracking scans and/or carrier-provided photos, constitutes proof of delivery.

• Claims of non-receipt after confirmed delivery will not be eligible for refund or replacement.

• If a package is retrieved by a neighbor, housemate, or other third party after delivery, this is considered outside our control and not covered by our shipping protection.

• Carriers like UPS typically do not reimburse senders for successfully delivered items, and default insurance (if applicable) is often limited to $100.

By placing an order with Rare Tequilas, you agree to these delivery terms and acknowledge that responsibility for the package transfers to you upon confirmed delivery.

Refunds and Replacements

To be eligible for a refund or replacement, customers must provide the following documentation:

1. Video Recording: A clear and continuous video recording of the package being opened upon arrival is required. This video must start before the package is opened and continue until the contents are fully visible.

2. Image of Contents: An image of the contents of the package in their original form is required. This image must show:

   • The contents in their original box.
   • The contents in their original bottle packaging material, if applicable.

Failure to provide the necessary video and image documentation may result in the denial of a refund or replacement request. This policy helps ensure the integrity of the process and prevents potential fraud.

Shipping: We cannot guarantee or estimate delivery dates or times, depending on the shipper used for your state some deliveries can take longer to arrive. Upon Delivery, an adult of the age of 21+ must be present to take delivery, if not the delivery will be re-attempted before being returned back to us. If delivery is unsuccessful due to the customer refusing the package or being unavailable the sign for the package after three attempts, they will be refunded for the cost of the product, minus the cost of shipping and an additional $15 return to shipper fee.

Non-California Residents:

Residents not residing in California take full responsibility for determining if their state or county laws allow the shipping.

Eligibility You must be at least 21 years old to purchase alcohol from our store. By using our services, you confirm that you meet the legal drinking age requirements in your jurisdiction.

Payment Methods RARETEQUILAS.COM accepts payments via credit card, debit card, and cryptocurrency. By making a purchase, you authorize us to charge your selected payment method for the total amount of your order, including any applicable taxes and fees.

Cryptocurrency Payments

• We accept cryptocurrency payments through Crypto.com Pay and other authorized providers.

• All cryptocurrency transactions are final and non-reversible once confirmed on the blockchain.

• Customers are responsible for ensuring they send the correct amount to the provided wallet address.

• Cryptocurrency payments are subject to network fees, which the customer must bear.

• Refunds for orders paid with cryptocurrency will be processed in USD or store credit, based on the exchange rate at the time of the refund.

• We do not guarantee the stability or valuation of cryptocurrency payments.

Order Processing & Cancellations

• We reserve the right to cancel any order flagged as potentially fraudulent or high-risk.

• If an order is canceled due to fraud concerns, any payment made will be voided or refunded in accordance with our policies.

• Orders cannot be modified once they have been processed and shipped.

Chargebacks & Disputes

• Customers who dispute payments via their financial institution must contact us first to attempt resolution.

• Fraudulent chargebacks will be reported, and we reserve the right to ban customers who initiate false disputes.

• Cryptocurrency transactions cannot be reversed; disputes regarding these payments will be handled through our internal refund and dispute process.

Compliance & Restrictions

• Customers must comply with all local, state, and federal laws regarding alcohol purchases.

• We do not sell to regions where alcohol shipments are restricted.

• RareTequilas.com reserves the right to refuse service to anyone for any reason.

Limitation of Liability We are not responsible for any lost, stolen, or incorrect transactions involving cryptocurrency payments. Customers assume all risk related to cryptocurrency transactions.

Changes to Terms of Service

Please note that these Terms of Service are subject to change at any time without prior notification. It is the customer's responsibility to review the Terms of Service periodically for any updates or changes.
